TERMS AND CONDITIONS OF USE OF THE DONATION PLATFORM

1. PREMISES AND DEFINITIONS
1.1. This document (hereinafter the " Terms ") governs access to and use of the digital platform www.stravarda.org (hereinafter the " Platform "), managed directly by Stravarda ETS (hereinafter the " Foundation "), for the collection of donations pursuant to Legislative Decree 117/2017 (Third Sector Code, hereinafter the " CTS ").
1.2. Definitions :
- Donor : natural or legal person who makes a donation through the Platform;
- Donation : a free donation of money to the Foundation, without compensation, made on a voluntary basis;
- Fiscal Receipt : certification issued pursuant to art. 83 CTS to allow the Donor to take advantage of the tax benefits provided by law.
2. PURPOSE OF THE PLATFORM
2.1. The Platform allows Donors to make unrestricted donations to support the Foundation's institutional activities, as defined in the Statute and in accordance with the purposes set out in Article 5 of the CTS.
2.2. The donations collected are intended to further the Foundation's statutory objectives and will be used in accordance with the decisions of the competent bodies, in compliance with transparency and industry regulations.
2.3. The Foundation is committed to ensuring maximum transparency in the use of collected resources, periodically publishing reports on its activities.
3. DONATION METHODS
3.1. The Donor can make a donation by following the guided procedure on the Platform:
- Enter the desired amount (minimum: €10.00 – no maximum limit);
- Enter the personal data required to confirm the donation and, if requested, to issue the tax receipt;
- Choice of payment method among those available (see art. 3.2);
- Completing the payment process.
3.2. Available payment methods :
- Shop Pay : payment via Shop Pay gateway (managed by Shopify Payments);
- Bank transfer : direct transfer to the Foundation's IBAN (instructions will be provided at the time of donation; the donation is finalized upon receipt of the funds).
3.3. Confirmation of donation :
- For payments via Shop Pay: immediate confirmation via email to the indicated address;
- For bank transfers: confirmation upon crediting the amount to the Foundation's account (approximately within 1-3 working days).
3.4. Donation Type : The Platform accepts only one-time donations . There are no recurring/periodic donation features.
4. LEGAL NATURE OF THE DONATION
4.1. The donation is a voluntary and gratuitous act of generosity, not reciprocal. The Foundation has no obligation to provide any compensation to the Donor.
4.2. Donations are irrevocable once completed, except as provided in Article 5 (Revocation and Refund) in the event of a technical error or unauthorized charge.
4.3. The Foundation does not issue electronic invoices as donations do not constitute consideration for the sale of goods or provision of services.
5. REVOCATION AND REFUND
5.1. Consumer right of withdrawal (Article 59 of the Consumer Code) : Donations made through the Platform are not subject to the right of withdrawal pursuant to Articles 52 et seq. of Legislative Decree 206/2005 (Consumer Code), as they fall within the exclusion provided for by Article 59, paragraph 1, letter o): "service contracts in the betting and lottery sector, provision of non-residential accommodation, transport of goods, car rental, catering services or services related to recreational activities, where the contract provides for a specific date or period of performance" and, by analogy, charitable services completed immediately upon payment of the donation .
5.2. Refund due to error or unauthorized charge : The Donor may request a refund of the donation within 7 (seven) working days from the date of the transaction exclusively in the following specific cases:
- Material error in the amount donated (e.g. double charge, incorrect amount due to typing error);
- Unauthorized or fraudulent charge;
- Documentable technical malfunction of the Platform or payment system.
5.3. Refund procedure :
- The request must be sent by email to: info@stravarda.org;
- Email subject: "Donation Refund Request – [Donor Name];
- Attach: payment receipt, detailed reason for the error, IBAN bank details for the refund;
- The Foundation will examine the request within 15 (fifteen) working days of receipt;
- If the request is accepted, the refund will be made within a further 30 (thirty) working days by bank transfer.
5.4. Refund Exclusion : Refund requests are not permitted for:
- Donor's second thoughts or change of will after the donation has been completed;
- Requests beyond the 7 working days deadline;
- Donations made with full awareness and intention.
6. TAX RECEIPT AND TAX TREATMENT
6.1. The Foundation issues a Tax Receipt pursuant to Article 83 of the Italian Tax Code (CTS) to Donors who request it and provide the necessary information, to enable them to benefit from the tax breaks provided for by:
- Art. 83, co. 1, CTS : 30% IRPEF deduction for amounts up to €30,000 per year (natural persons);
- Art. 83, paragraph 2, CTS : deduction from total income up to 10% of declared income (natural and legal persons).
6.2. Method of issuing the Fiscal Receipt :
- The Receipt is issued and sent via email within 60 (sixty) days from the date the donation is credited;
- Shipping address: the one indicated by the Donor at the time of the donation;
- Data required for issuance : name, surname (or company name for organizations), tax code, complete address, amount donated, payment method;
- For anonymous donations or those without an explicit request for a receipt, a receipt will not be issued.
6.3. Donor's Responsibility : The Donor is responsible for verifying the accuracy of the information provided (in particular: tax code, name, address). The Foundation cannot be held responsible for errors in the data provided by the Donor that result in the invalidity or unusability of the Tax Receipt for tax deduction purposes.
7. PROCESSING OF PERSONAL DATA
7.1. The personal data collected through the Platform are processed by the Foundation as Data Controller , in compliance with EU Regulation 679/2016 (GDPR) and Legislative Decree 196/2003 (Privacy Code).
7.2. Data collected :
- Identification data : name, surname, tax code;
- Contact details : email address, postal address (for issuing tax receipts);
- Financial data : donation amount, payment method.
7.3. Purpose of the processing :
- Operational management of the donation;
- Issuance of the Fiscal Receipt (where required);
- Accounting, tax and legal obligations;
- Institutional communications relating to the Foundation's activities (subject to the Donor's explicit consent).
7.4. Legal basis for processing :
- Art. 6, par. 1, letter b) GDPR : execution of pre-contractual and contractual measures (donation management);
- Art. 6, par. 1, letter c) GDPR : fulfillment of legal obligations (data retention for tax and accounting purposes);
- Art. 6, par. 1, letter a) GDPR : explicit consent (for any marketing communications).
7.5. Communication to third parties : Personal data may be communicated to:
- Shop Pay / Shopify Payments : for the management of payments via the Shop Pay gateway (as Data Controller pursuant to art. 28 GDPR);
- Banking institutions : for the execution and reconciliation of bank transfers;
- Tax and public authorities : for legal obligations (e.g. mandatory document retention).
7.6. Data retention :
- Data for donation management : 10 years from the date of the donation (pursuant to tax and accounting obligations);
- Data for marketing communications (if consent is provided): until consent is revoked.
7.7. Donor Rights: The Donor may exercise the rights set forth in Articles 15-22 of the GDPR (access, rectification, erasure, restriction, portability, objection) by writing to: info@stravarda.org.

8. PAYMENT SECURITY
8.1. The Foundation guarantees the security of transactions through:
- SSL/TLS protocol for data encryption in transit;
- Shop Pay : payment system compliant with PCI-DSS (Payment Card Industry Data Security Standard);
- Bank Transfer : Traditional banking system subject to European Payment Services Regulations (PSD2).
8.2. The Foundation does not store credit/debit card data on the Platform. This data is managed exclusively by third-party payment providers (Shop Pay/Shopify Payments) as data controllers.
8.3. The Donor is responsible for safeguarding his/her payment system access credentials and undertakes not to disclose them to third parties.
9. RESPONSIBILITY AND LIMITATIONS
9.1. Limitations of the Foundation's liability : The Foundation assumes no liability for:
- Malfunctions, interruptions or delays attributable to third-party providers (Shop Pay, banks, internet connectivity providers);
- Scheduled or extraordinary maintenance of the Platform, communicated with sufficient notice where possible;
- Errors in the data entered independently by the Donor (amount, coordinates, personal data);
- Inability to issue a Fiscal Receipt due to incomplete or incorrect data provided by the Donor.
9.2. Force majeure : The Foundation is exempt from any liability in the event of force majeure, fortuitous event, third-party action, or interruptions to essential public services that prevent the fulfillment of its obligations.
9.3. Platform Availability : The Foundation reserves the right to temporarily suspend the Platform for routine or extraordinary maintenance, providing advance notice where possible. It assumes no responsibility for any disruptions resulting from technical causes beyond its control.
10. CHANGES TO THE CONDITIONS
10.1. The Foundation reserves the right to modify these Conditions at any time for organizational, regulatory, or technical reasons.
10.2. The changes will be published on the Platform with an indication of the date of last update and will be effective from the date of publication.
10.3. Donations made before the changes are published will remain governed by the Terms and Conditions in effect at the time the donation is made.
10.4. The Donor is invited to periodically consult the Conditions to be informed of any updates.
11. APPLICABLE LAW AND JURISDICTION
11.1. These Conditions are governed by Italian law and, in particular, by Legislative Decree 117/2017 (Third Sector Code), by EU Regulation 679/2016 (GDPR), and by Legislative Decree 206/2005 (Consumer Code), where applicable.
11.2. Competent court : For any dispute relating to the interpretation, execution or validity of these Conditions, the Court of Vicenza shall have exclusive jurisdiction , except for mandatory provisions of law regarding consumer protection which attribute different territorial jurisdiction.
11.3. Alternative Dispute Resolution (ADR/ODR) : Pursuant to art. 141-sexies of Legislative Decree 206/2005, the Donor-consumer may avail of:
- Alternative dispute resolution (ADR) procedures;

12. FINAL PROVISIONS
12.1. Partial invalidity : if one or more clauses of these Conditions are declared null or ineffective, the nullity or ineffectiveness will not extend to the other clauses, which will remain fully valid and effective.
12.2. Waiver : Any tolerance by the Foundation of any default or delay by the Donor does not constitute a waiver of the rights arising from these Conditions.
12.3. Communications : All communications relating to these Conditions must be sent in writing to the addresses indicated in Article 13.

ACCEPTANCE OF THE TERMS
By making a donation through the Platform, the Donor expressly declares to:
- Having read and fully understood these Conditions;
- Unconditionally accept all the above clauses;
- Having read the Privacy Policy published on the Foundation's website;
- Make your donation voluntarily, consciously, and freely.
